Maharashtra Shops And Establishments (Regulation Of Employment And Conditions Of Service) (Amendment) Rules, 2023


This rule has been formulated by the Government of Maharashtra by exercising the powers conferred to it by sub-section (1) of section 37 of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 to bring an amendment to rule 16 of the 2018 Rules. Rule 16 of the 2018 rules mandates an establishment, carrying out its operation in shifts, to post a notice of the shift schedule well before mentioning the names and designation of all persons allocated to work in that shift. The rationale behind such a rule is that every worker is well-aware of his weekly holiday, the shift in which he is and the total number of hours he has to work.

The 2018 rules mandated the publishment of the said notice on the website as well as on any noticeable place of the premises of the establishment on the notice board. However, the 2023 rules (source) brought an amendment to rule 16 by substituting the words “website or” for the words “website and”. The amendment to the rule now does not make it mandatory for the establishment to publish the notice on both the website and the physical premises.
