Maharashtra State Rights Of Persons With Disabilities Rule 2023

The Government of Maharashtra, in exercising the powers conferred by sub-section (1) of section 101 of the Rights of Persons with Disabilities Act, 2016, has formulated the Draft Maharashtra State Rights of Persons with Disabilities Rules, 2023 with the aim of achieving welfare of the people with disabilities in Maharashtra. The draft rules propose the creation of a State Committee to facilitate research on disability. It also creates a provision for the appointment of a limited guardian who may aid the person with disability by taking legally binding decisions on his behalf after consulting the latter. The guidelines of the draft rules provide a detailed framework on the appointment, removal and functions of a limited guardian.

 

The said rules also lay down the procedure for application of certificate of disability, its issuance procedure, validity, and the grievance mechanism related to this issue. A state fund shall also be created, according to the rules, for the welfare of persons with disabilities and there shall also be a governing body to manage and utilise these funds. The state government of Maharashtra will take these draft rules into consideration after the expiry of a period of 30 days from the date of publication of this notice in the official gazette of the Maharashtra government.
