The state government of Manipur has, through a notification dated November 2, 2023, issued the Manipur Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2021 thereby repealing the Manipur Shops and Establishments Act, 1972 and Manipur Shops and Establishments (Regulations and Conditions of Service) Ordinance 2021. The act seeks to modify and consolidate the laws concerning the regulation of employment and other related conditions of service of the workers employed in shops and other establishments.
This act is only applicable to shops and establishments which have ten or more workers employed and it mandates every such establishment to register itself under this act within six months of its commencement to obtain a Labour Identification Number. The act also outlines certain duties of the employer with respect to their employees. This includes ensuring no discrimination against women in matters related to recruitment, wages, promotion etc.; no women shall work in the establishment except between 6 am to 9 pm and create a safe working environment for them; The employer shall take every effort to ensure a safe and healthy working environment for all its employees; no worker shall be asked to work for more than 48 hours a week and 9 hours a day; if any worker does overtime, he/she shall be entitled to wages at the rate of twice his ordinary rate of wages.
Every worker shall be entitled to a weekly holiday with wages, according to the act along with other provisions of annual leave, causal and sick leaves, etc. He shall also be entitled to eight paid festival holidays including Independence Day, Republic Day and Gandhi Jayanti along with five other holidays. For the welfare of the employees, the employer shall ensure accessibility of clean drinking water, separate washrooms for male and female, creche facility, first-aid and a common canteen.
