The state government of Maharashtra has passed the Maharashtra Industry, Trade and Investment Facilitation Act, 2023 with the objective of creating a legislation designed to establish a streamlined Single Window System for efficiently providing permissions necessary for setting up and running industries. The aim is to boost the competitiveness of the State in trade and investments, foster an environment conducive to Ease of Doing Business, including mechanisms for addressing grievances. Additionally, the legislation seeks to create and manage a portal offering comprehensive information essential for investment within Maharashtra, along with associated matters and incidental aspects.

 

The act specifies that anyone who wishes to establish a new industrial undertaking or continue the operation of an existing industrial undertaking in the State may submit an application in electronic form through the Single Window System, along with the required fee, to obtain the necessary permissions. An ‘Empowered Committee’ shall be created which would consider and dispose off the applications for permissions accordingly and shall also be responsible for the monitoring of the functioning of the Single Window System. The decisions of such a committee would be binding on all the concerned persons irrespective of any relevant law. A ‘Supervisory Committee’ shall also be formed which would give directions to the Empowered Committee and make policy recommendations to the concerned authorities. The Maharashtra Industry, Trade and Investment Facilitation Cell (MAITRI) shall be the Nodal Agency for Single Window System in Maharashtra which would guide and assist entrepreneurs for setting up industrial undertakings along with other functions such as monitoring the status of applications and coordinating with various competent authorities.
