The government of Uttar Pradesh in the exercise of the powers conferred by sub-section (3) of section 5 of the Uttar Pradesh Dookan Aur Vanijya Adhisthan Act, 1962, has exempted the Information Technology (IT) and Information Technology Enabled Services (ITES) from the provisions of section 5, of the said act, which specifies the hours of business for a commercial establishment. The notification stated that the exemption is being made and the IT and ITES related establishments are being placed in Schedule II due to public interest.
Section 5 prescribes the opening and closing hours of any shop or commercial establishment except the ones which are mentioned in Schedule II. With the placing of IT and ITES establishments under schedule II, such establishments would not only have to no longer comply with the hours of business as specified by the act but also would not be governed by section 8 of the act which specifies the days of holidays in an establishment.
